1.1. At the French Australian Lawyers Society (‘FALS’ or ‘we’) we are committed to maintaining policies and procedures which protect the privacy of personal information collected from our members and others who visit our website or participate in our events.

1.2. This Privacy Policy explains how we collect, use and protect the personal information you provide when you use this site or participate in any of our events. By using this site or participating in a FALS event, you signify your consent to this Privacy Policy. Please read it carefully before using the site or participating in an event.

2. Kinds of Personal Information We Collect and Hold

2.1. We collect information that personally identifies you (‘Personal Information’) only if you choose to share it with us. This includes:

  • your name, contact information (e.g.  email addresses and postal address) and any other information required when you register for our events or communicate with us;
  • any content you post on our website;
  • any additional information necessary for us to respond to your enquiries; and
  • any other personal information that may be required to facilitate your dealings with us.  

2.2. All correspondence from you may also be collected and stored. This may be via email, mail, telephone or directly through the website.

3. Kinds of Non-Personal Information We Collect and Hold

3.1. We automatically collect information that does not reflect or reference an individually identifiable user (‘Non-Personal Information’) to help us understand how our users use the site. Like most websites, we automatically collect and use the data contained in log files.

3.2. The information in the log files may include your IP (internet protocol) address, your ISP (internet service provider), the Web browser you used, time you visited the site, which pages you visited and other anonymous site usage data.

4. What We do With the Information

4.1. We use and disclose your Personal Information and Non-Personal Information for the following purposes:

  • responding to your enquiries;
  • keeping you informed about topics of interest to you;
  • as part of our normal operations and administration of FALS;

5. Disclosure of the Information

5.1. We will not sell your Personal Information to third parties.

5.2. We will only disclose your Personal Information to third parties with your permission or as set out in this Privacy Policy.

5.3. From time to time we may establish relationships with service providers who assist us in providing the services to you through the operation of FALS, including this site. To the extent that we share Personal Information with a service provider so they may provide these services, we would only do so when strictly necessary for the service sought from the third party to be provided to us.

5.4. We may disclose your information to our professional advisors in order to obtain professional advice.

5.5. We may disclose your information to other parties as permitted or required by law.

5.6. Any Non-Personal Information, communications and material you send to us or post on this website may be kept, used and disclosed by us on a non-confidential basis. We are free to use and reproduce such information for any purpose set out in this Privacy Policy.

6. Overseas Disclosure of the Information

6.1. We may disclose your Personal Information to overseas recipients if necessary for the purposes set out in this Privacy Policy. For example, if FALS and a French service provider are jointly organising a continuing legal education seminar in Paris, we may share your Personal Information with the French service provider.

6.2. By using this site and/or providing us with your Personal Information, you consent to the collection, use, disclosure and storage of your Personal Information outside of Australia, consistent with this Privacy Policy. You acknowledge that the overseas recipients of your Personal Information may be located outside Australia including in France. Please note that the privacy laws and other laws of such countries might not be as comprehensive as those in Australia.

6.3. You acknowledge that FALS is not required to ensure that overseas recipients handle your Personal Information in compliance with Australian privacy laws. However, where practicable in the circumstances, we will take reasonable steps to ensure that overseas recipients use and disclose such Personal Information in a manner consistent with this Privacy Policy.

7. Security of Collected Information

7.1. The information that we collect is stored on servers that are managed using standard security procedures and practices appropriate to the nature of the information. These security measures are designed to protect the information from unauthorised access, destruction, use, modification or disclosure.

7.2. However no transmission over the Internet can be designed to be 100 per cent secure. As a result, we cannot and do not guarantee or warrant the security of any information you transmit on or through the site, and you do so at your own risk.

8. Public Information

8.1. Please be aware that, as with social media sites generally, whenever you post content to any community or interactive areas of the site such areas may be accessed by the public. This means that any person or entity with access to such information can potentially use it for any purpose, including sending unsolicited communications. Please be mindful of the Personal Information you share in such forums.

9.1. If you wish to access your Personal Information held by us or if you believe that any Personal Information we hold about you is incorrect or incomplete, please email us at contact@fals.org.au so that we may provide access to, or update or correct (as applicable) any such information.

10.1. You may complain about the handling of your Personal Information or other privacy related matters by emailing us at contact@fals.org.au.

10.2. We will do our best to respond to all requests in a timely manner. If we are unable to resolve your complaint, we will inform you of the next steps available to you.
